Legal Terms for purchases via Stripe (“Stripe Legal Terms”)

In the case of purchasing BRYTER products using the payment option provided by Stripe Technology Company Limited (STC) (“Stripe”), the following terms shall apply:

1. General

Unless defined in these Stripe Legal Terms, definitions are set out in Appendix 1 (Definitions) which are incorporated into the Stripe Legal Terms by reference.

The subscription period specified on the invoice issued upon successful purchase of BRYTER products via Stripe constitutes the Initial Term as defined in the applicable Master Service Agreement (“MSA”) and its Definitions. Any subsequent renewal terms, if applicable, will be invoiced in accordance with the provisions of the MSA.

The contractual documents linked in section 2 and section 3 are made available on the website in their current version together with the version number and can be downloaded there via the download button; previous versions can also be viewed there. The versions applicable to the contractual relationship are those displayed during the checkout process at the time the contract was concluded. For evidentiary purposes, the invoice states the purchase date as the date on which the contract was concluded and the version number of these Stripe Legal Terms. In the event of automatic renewal of the subscription, the versions of the contractual documents incorporated at the time the contract was concluded continue to apply.

Notwithstanding section 15.2 of the MSA, for Order Forms with an Initial Term of one (1) month concluded via the payment service provider Stripe, the following shall apply: the Order shall automatically renew for successive one-month periods unless terminated by either Party at any time with effect from the end of the then-current calendar month. Upon effectiveness of such termination, access to and use of the Software will cease and any fees incurred or accrued up to the effective termination date remain payable. All other provisions of the MSA shall remain unaffected.
